Are performers in shows treated as employees or independent contractors?

Most shows in town treat the dance casts as employees... you will receive a paycheck that has Federal, State and Local taxes taken out as well as Medicare and Social Security.  In addtion, you will probably receive health benefits after several months of continuous work and other employee benfits as dictated by the company.

Variety and specialty acts are usually independent contractors.  They are usually paid directly from the company and payroll taxes are the responsibility of the performer.  Most companies will offer written contracts to variety acts, although there is a trend by some producers to offer work verbally and never sign anything in writing.  Please do your research before agreeing to work without a written contract.  Speak to several other acts in the show to see if they have actually been paid on time and on a constant basis.

Dancers in casts will almost always have a written contact and with a stipulation that they must pay to get out of a contract early.
